Commission Opens Formal Investigation into Alleged Slovenian State Aid Granted to Javni Zavod Lekarna Ljubljana
The Commission has launched an in-depth investigation into whether the transfer of certain assets from the Municipality of Ljubljana to Javni Zavod Lekarna Ljubljana complies with EU State aid rules.
In March 2020, the Commission had concluded that the measures either involved no aid or qualified as existing aid. However, the General Court partially annulled that decision on 27 April 2022, and the Court of Justice confirmed this ruling on 5 September 2024. The Court determined that the Commission should have opened the formal investigation procedure in relation to the asset transfers to Lekarna Ljubljana.
The Commission will now investigate whether the asset transfers qualify as existing aid or aid compatible with the internal market. Launching an in-depth investigation allows Slovenia and other interested parties to submit comments, without prejudicing the final outcome.
