Conception and implementation.
We assess whether planned or implemented measures constitute state aid, including the application of the market economy operator principle and the options for compatibility of the aid.
We analyse the structuring of public interventions, the application of the General Block Exemption Regulation and the de minimis rules.
We know the relevant actors and institutions and provide targeted advice on state aid issues, including in the context of proposed legislation.
Complaints.
We advise clients on whether market players have benefited from state aid in breach of the relevant European regulations. We take care of drafting complaints and monitor actively the administrative procedure and the handling of the complaint.
We assist clients during meetings with the Commission and the EFTA Surveillance Authority.
We file complaints to the European Ombudsman in the event of maladministration by the European institutions.
Litigation.
We represent clients before the European Courts (General Court, Court of Justice, and EFTA Court) in actions for annulment, failure to act, and preliminary rulings.
We defend cases in national courts on all state aid matters, including classification issues and recovery orders.
We coordinate strategies with specialised boutiques or full-service law firms seeking our expertise in state aid litigation and arbitration.
